Serious Offense
As a result of the lack of appropriate punishment, many parents have further questioned the legality of what happened to Hannah. [Case in point:] The Texas Education Code is very straightforward, as stated in the code of conduct that governs the school district.
“A student WHO engages in conduct that contains elements of the offense of assault (with bodily injury) under 22.01(a)(1) of the Penal Code; (27,28)” “A student WHO engages in conduct that contains elements of the offense of assault (with bodily injury) under 22.01(a)(1) of the Penal Code SHALL be removed from the regular campus and placed into a DAEP.”

A student who commits a “serious offense” as defined by the code of conduct is subject to the possibility of being expelled from the institution in addition to being sentenced to campus probation as part of the repercussions of their action. Before every single DAEP hearing, this cautionary statement is delivered to the audience.
